1. Acceptance of Terms

By accessing or using Fence ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use our Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

Fence is a comprehensive security vulnerability scanner and SSL/TLS certificate monitoring service. We provide:

• Automated vulnerability scanning (OWASP Top 10, CVE detection, security headers, SSL/TLS configuration)
• SSL/TLS certificate monitoring with expiration alerts
• Multi-channel notifications (email, Slack, Discord, Telegram, WhatsApp, Teams, Signal, webhooks)
• Plain English vulnerability reports with remediation guidance
• Team collaboration features (Startup/Enterprise)
• Subdomain enumeration and dark web scanning (Enterprise)
• API access and CI/CD integration (Startup/Enterprise)

3. Account Registration and Use

3.1 Account Creation

To use our Service, you must:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Be at least 13 years old (or the age of majority in your jurisdiction)
• Not create multiple free accounts to circumvent limits

3.2 Account Security

You are responsible for:

• All activity under your account
• Maintaining the confidentiality of your password
• Notifying us immediately of any unauthorized access

3.3 Prohibited Activities

You may not:

• Monitor domains you don't own or have permission to monitor
• Use the Service for illegal purposes or to violate any laws
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the Service
• Use automated tools to abuse the Service or bypass rate limits
• Resell or redistribute the Service without authorization

4. Domain Verification

Before monitoring a domain, you must verify ownership through one of these methods:

• DNS TXT Record: Add a verification TXT record to your DNS
• Meta Tag: Add a verification meta tag to your website's HTML

This verification prevents abuse and ensures you have the right to monitor the domain. Monitoring unverified or unauthorized domains may result in account suspension.

5. Subscription Plans and Pricing

5.1 Tiers

We offer four subscription tiers:

• Hobby: $0/month, 3 domains, SSL/TLS + security headers, weekly scans, community support
• Startup: $49/month, 25 domains + .onion sites, OWASP Top 10 + CVE detection, daily scans, API access, subdomain enumeration, AI chatbot support
• Enterprise: $499/month, 100 domains + IoT/API endpoints, hourly + on-demand scans, full OSINT, internal scanner, priority chatbot + Slack support
• Custom: Custom pricing, unlimited domains + users, source code access, white-label reports, custom integrations, dedicated engineer

5.2 Billing

• Subscriptions are billed monthly or annually
• Payments are processed through Stripe
• All fees are in USD unless otherwise stated
• You authorize us to charge your payment method for recurring fees

5.3 Price Changes

We may change prices with 30 days' notice. Existing subscribers will be grandfathered at their current price for the remainder of their billing cycle.

6. Cancellation and Refunds

6.1 Cancellation

You may cancel your subscription at any time through your account dashboard. Cancellations take effect at the end of your current billing period.

6.2 Refund Policy

• 14-Day Money-Back Guarantee: New subscribers can request a full refund within 14 days
• Partial Refunds: Considered on a case-by-case basis for service outages
• No Refunds: For violations of these Terms or misuse of the Service

7. Service Availability and Uptime

7.1 Uptime Commitment

• Hobby/Startup: Best-effort availability (no SLA)
• Enterprise/Custom: 99.9% uptime SLA with credits for downtime

7.2 Maintenance

We may perform scheduled maintenance with advance notice. We will minimize disruption and perform maintenance during low-traffic periods when possible.

7.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any feature of the Service with reasonable notice. We will not be liable for any such changes.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.

8.1 Data Retention

• Scan history: 90 days (Hobby), 1 year (Startup/Enterprise/Custom)
• Account deletion: Your data is permanently deleted within 30 days

9. Intellectual Property

9.1 Our Property

The Service, including all content, features, and functionality, is owned by Fence and protected by copyright, trademark, and other intellectual property laws.

9.2 Your Data

You retain all rights to the domains and data you monitor through our Service. We do not claim ownership of your domain names or certificate data.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" without warranties of any kind
• We are not liable for missed alerts or certificate expirations
• We are not responsible for downtime, data loss, or business interruption
• Our total liability shall not exceed the fees you paid in the last 12 months
• We are not liable for indirect, incidental, or consequential damages

Important: Fence is a monitoring tool. You remain responsible for renewing your certificates. Our alerts are a convenience, not a guarantee.

11. Indemnification

You agree to indemnify and hold harmless Fence from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Monitoring domains without proper authorization

12. Termination

12.1 Termination by You

You may terminate your account at any time through your account settings.

12.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or abusive behavior
• Your account has been inactive for over 12 months (Hobby tier)
• Payment fails repeatedly

12.3 Effect of Termination

Upon termination, your access to the Service will cease immediately. Your data will be deleted according to our retention policies.

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

13.2 Dispute Resolution

For disputes under $10,000, you agree to first attempt informal resolution by contacting us at [email protected].

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fence.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.

14.3 Assignment

You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
